Probate of a Will

Probate is the legal term for the process of proving up a will in court. During probate, an executor or an administrator will be appointed by the court and the assets of the deceased are inventoried and all debts, creditor claims and taxes are paid. The remaining assets are distributed to the named beneficiaries and heirs. The distribution of the assets is the responsibility of the executor named in the will or the person appointed by the court to act as the personal representative if the will does not name an executor. The distribution  of assets can happen very soon after the will is probated or it can take many months. How long this process will take depends on the amount and type of assets of the estate.

Muniment of Title

Ifhe only reason for probating a will is clear title to property, then the will can be admitted to probate as a Muniment of Title. This is used when there are no outstanding debts and no need to appoint an executor or administrator.

Intestate Administration

A decedent who does not live a will is said to be intestate. When this occurs, a personal representative of the decedent can apply for administration of the estate. During this process the court will determine the identity of the heirs in a procedure know as a Determination of Heirship. The court must appoint an attorney to represent any unknown heirs of the decedent and will also determine the shares of the estate that are due to each heir.
