Modification

The terms of a divorcechild custody or child support order may not be permanent. Among other requirements, all changes to child support or custody orders must be in the best interest of the child.The Texas Family Code provides for modifications of child support if at least three years have passed since the order to be modified was rendered and the amount differs by $100 or 20% or where the circumstances of the parties or the child have materially or substantially changed. For example, where a parent paying child support is remarried and has another child. An order for custody or visitation can be changed if there is a material and substantial change in the circumstances of the children or the parties. For example, if one parent moves a long distance from the child or engages in some illegal activity.
